Terms and Conditions for Pest Management Services
Effective Date: July 15, 2025
These Terms and Conditions (“Terms”) govern the provision of pest management services by First Care Services (“we,” “us,” or “our firm”) to you, the client (“you” or “the client”). By engaging our services, you agree to be bound by these Terms.
As an accredited provider of new-generation pest management solutions since 2010, First Care Services is committed to delivering effective, safe, and reliable pest control with guaranteed results for residential and commercial properties in Melbourne and Victoria.
1. Scope of Services
1.1 Service Proposal: Our services are limited to the pest species and property areas specified in the Pest Management Proposal or invoice provided to you (“the Proposal”). Any additional pest species or areas will require a new or amended Proposal and may incur additional charges.
1.2 Service Limitations: While we strive for comprehensive eradication using eco-friendly methods where appropriate, the effectiveness of treatment can be affected by factors outside our control, such as severe structural issues, poor sanitation, or ongoing environmental conditions.
1.3 Termite Barriers: Specific terms and conditions for pre-construction termite barriers or extensive termite management programs will be detailed in a separate, dedicated agreement.
2. Client Responsibilities and Health & Safety Information
Your cooperation is essential for the effective and safe delivery of our services. You must:
2.1 Advise of Sensitivities: Inform us prior to treatment of any pets, personal or staff allergies, sensitivities to chemicals, or any other health concerns of occupants that may be affected by pest management agents.
2.2 Evacuation & Ventilation: Any persons who are particularly sensitive, or who suffer from allergic reactions, should, as a matter of precaution, remain out of the premises for a period of at least 4 hours after treatment and not return until after the premises have been thoroughly ventilated.
2.3 Protection of Occupants & Belongings:
* Remove or adequately protect all people, animals, birds, and fish from the treatment area for the duration specified by our licensed operator.
* Cover all food items, food preparation surfaces, and food utensils.
* Protect sensitive items (e.g., electronics, artwork) as advised by our operator.
2.4 Contact with Treated Surfaces: Avoid contact with treated surfaces until the control agent has completely dried.
2.5 Follow Verbal & Written Advice: Strictly observe all verbal advice provided by our licensed operator at the time of treatment, in addition to any written instructions on the Proposal or product labels.
2.6 Post-Treatment Ventilation: Ensure your premises are properly ventilated after treatment. If applicable, leave any air-conditioners on ‘vent mode’ (circulating outside air into the building) for a period of at least four hours after the treatment or after re-occupying.
2.7 Water Tanks: You must advise us of any water tank installations. No treatment can be carried out around water tanks that are not fully sealed or near water collection areas to prevent contamination.
2.8 Access: Provide our technicians with safe and unobstructed access to all areas requiring treatment as outlined in the Proposal.
3. Payment Terms
3.1 Payment Due Date: Unless specific written arrangements have been provided and agreed upon by First Care Services, the full contract price (“Investment”) shall be due and payable and recoverable by our firm on the commencement of the initial treatment.
3.2 Non-Payment: Any Free Service Period (as defined below) or warranty shall be null and void unless all monies due and payable to First Care Services have been paid in full within the standard terms of business.
3.3 Payment Methods: Payments can be made via [List accepted payment methods, e.g., bank transfer, credit card, cash].
4. Service Guarantee / Free Service Period
4.1 Conditions of Guarantee: Where a “Free Service Period” or “Service Guarantee” has been provided in the Proposal, we agree to provide you with any necessary remedial treatment(s) as may be required to the nominated property, at no additional cost to you. This service is conditional upon:
* You notifying us of signs of pest infestation within the specified Free Service Period.
* All monies due and payable to First Care Services having been paid in full.
* No other pest control treatments or products having been applied to the treated areas by you or any third party during the Free Service Period.
* The infestation being of the same pest species as originally treated.
4.2 Remedial Treatments: Remedial treatments will be scheduled at our earliest convenience and may require follow-up visits.
4.3 Limitations of Guarantee: No responsibility is accepted, or warranty implied, for any damage or consequential losses that may occur as the result of past, current, or future pest activity. The guarantee specifically covers remedial treatment for the pest species named in the original Proposal, not compensation for damage.
4.4 Review of Program: If, during the course of the program, it is found that structural or environmental conditions significantly prevent us from performing any sections of the Management Program as intended, then the Free Service Period or the cost of your investment may have to be reviewed and adjusted by mutual agreement.
5. Limitation of Liability
5.1 To the maximum extent permitted by law, First Care Services shall not be liable for any loss, damage, injury, claim, or expense (including indirect or consequential loss) arising from or in connection with our services, except to the extent caused by our negligence or willful misconduct.
5.2 Our total liability to you for any claim arising out of or in connection with these Terms or the services provided shall not exceed the amount paid by you for the specific service giving rise to the claim.
5.3 We accept no responsibility for damage or consequential losses caused by pre-existing structural or environmental conditions, or by actions/inactions of the client or third parties that interfere with the effectiveness of the treatment.
6. Governing Law
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Victoria, Australia. You irrevocably agree that the courts of Victoria, Australia, shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
7. Entire Agreement
These Terms, together with the Proposal, constitute the entire agreement between you and First Care Services regarding the services and supersede all prior understandings, agreements, or representations, whether written or oral.
8. Changes to Terms
First Care Services reserves the right to update or modify these Terms at any time without prior notice. The most current version of the Terms will be posted on our website. Your continued engagement of our services after any such changes constitutes your acceptance of the new Terms.
